The declaration contains three special counts and the common count for goods sold and delivered. The first alleges that one Williams was indebted to the plaintiffs below; that defendant, in consideration that plaintiffs would release Williams’ debt, promised the plaintiffs to pay them the debt of Williams, and that they did release, &c.
