*699In an action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Westchester County (Tolbert, J.), entered January 6, 2005, which denied her motion for summary judgment dismissing the complaint.
Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed.
The plaintiff allegedly was injured when the wooden deck chair in which she had been sitting suddenly collapsed when she attempted to get out of it. The accident occurred on the porch of the defendant’s home. The plaintiff subsequently…
