The plaintiff, Michael Timpson, brought this Superior Court action against the defendant, Transamer-ica Insurance Company (Transamerica). Timpson’s complaint contained two counts. Count I alleged that because Trans-america wrongfully failed to defend him in an action brought by reporter Lisa Olson, Transamerica should reimburse him for legal fees and associated costs incurred by him in the *345course of his defense against Olson’s action.
