Henry Cowers, appellant, was charged with having violated an ordinance of the City of Yan Burén by erecting or placing a fence across a street in said city. There was a trial to a jury and at the conclusion of all of the testimony introduced by the parties, the court instructed, the jury to return a verdict of guilty, whereupon the j'ury returned a verdict of guilty and imposed a fine of $5. This appeal followed.
