Appeal from circuit court, New York county. Action by Andrew J. Delaney, as administrator, against the Pennsylvania Railroad Company, for the alleged negligence of defendant causing the death of plaintiff’s intestate. From a judgment entered on a verdict in favor of plaintiff for $4,297.36, and from an. order denying a motion for a new trial, defendant appeals.

The judgment appealed from awards to the plaintiff $3,500 for damages sustained by reason of the negligent acts of the defendant, resulting in the death of plaintiff’s intestate. In the early evening of October 4, 1891, the plaintiff’s intestate, a boy about eight years of age, came upon a dock which the defendant had leased from the city of New York, accompanied by his father and mother and three younger brothers and sisters.
