This is an action of trespass to try title brought on June 4, 1884, by -the appellees and others against the appellants to recover a part of the Epps 'D. Payne two-thirds of a league and labor of land. A trial at the February term, 1886, of the District Court of Comanche County resulted in. a judgment in favor of Mrs. Emma Simpson and Mrs. Hardeman, which was reversed by the Supreme Court in May, 1887. In August, 1887, the appellees, Mrs. Emma Simpson, Mrs. M. Hardeman, and Mrs. Fannie Smith, each joined by her husband, filed amended pleadings claiming an undivided…
