delivered the opinion of the court.

An action for damages for personal injuries sustained by plaintiff. A jury returned a verdict finding defendants guilty and assessing plaintiff’s damages at $5,000. Judgment was entered upon the verdict. Defendants’ motion for a new trial, made nine days after the entry of the judgment, was overruled.
