The defendant, Joseph A. McCann, demurs to the indictment filed against him by the grand jury of the county of New York on the 2d day of April, 1934, charging him with the crime of willfully omitting to perform a duty enjoined by law upon him as a public officer, on the grounds set forth in sections 275 to 279 of the Code of Criminal Procedure and further on the ground that the facts stated do not constitute a crime.
