MEMORANDUM OPINION
FLANNERY, District Judge.
This opinion addresses issues in the Round III briefing of challenges to regulations promulgated by the Secretary of the Interior under the Surface Mining Control and Reclamation Act of 1977 (“SMCRA” or “the Act”), 30 U.S.C.A. § 1201 et seq. (West Supp.1985). The history of this litigation is set out in this court’s Round I opinion filed July 6, 1984.
