This case comes here by petition in error and case-made. The assignments of error, embraced in the petition in error, are that the court erred in refusing to vacate the judgment that was rendered in the case on the 10th of September, 1926, and the court erred in overruling motion for a new trial, and the prayer for reversal is for restoration to all rights that were had before the order wag made.
