The defendant stands convicted, upon a jury verdict, of the crimes of attempted hindering prosecution in the first degree (Penal Law, §§ 110.00, 205.65) and attempted tampering with physical evidence (Penal Law, §§ 110.00, 215.40). The record establishes beyond a reasonable doubt that the defendant intended to commit the crimes of hindering prosecution and tampering with physical evidence if he had been afforded the opportunity to do so.
