Before the court is the petition of Willie Lee Pigee for the issuance of a writ of habeas corpus.

This petition is one of many submitted following the decision in Sandstrom v. Montana, 442 U.S. 510, 99 S.Ct. 2450, 61 L.Ed.2d 39 (1979), declaring unconstitutional a Montana jury instruction involving criminal intent. The Supreme Court found that the instruction could have been interpreted by the jury in a manner that would deny a defendant his right to due process of law.
