MEMORANDUM DECISION AND ORDER

COGAN, District Judge.

This is a habeas corpus petition under 28 U.S.C. § 2254 in which petitioner challenges his conviction for second degree murder. He raises three points of error in his petition: (1) the trial court erroneously admitted certain witness statements as excited utterances and excerpts from a detective’s memo book as past recollection recorded; (2) the evidence was inadequate to convict him beyond a reasonable doubt; and (3) the trial court erred in not grant ing an adjournment so petitioner could look for new counsel when he demanded new counsel…
