Avrum H. Dannen (plaintiff), as the trustee in bankruptcy of the estate of Diamond Drywall Service, Inc. (Drywall), brought suit against Jacqueline Scafidi (defendant) for an accounting and declaration of a trust. At the close of the plaintiff’s case, the trial court granted judgment in favor of defendant.
