The issues presented by the parties’ cross motions for summary judgment are (1) whether the referendum duly called by the defendant city and town of New London is a town meeting subject to the provisions of General Statutes § 7-6, and (2) whether the defendants violated the equal protection clauses of the fourteenth amendment to the United States constitution or article first, § 20, of the Connecticut constitution by refusing to allow the plaintiffs, who are nonresident taxpayers in New London, to vote in a referendum on the approval of a budget and tax rate ordinance.
