Plaintiff, the Buffalo Teachers Federation, sues under 42 U.S.C. § 1983 for declaratory and injunctive relief against the three members of the New York State Public Employment Relations Board (“PERB”). The gravamen of plaintiff’s complaint is that the State’s Taylor Law, which prohibits public employees from striking and mandates sanctions for violations of this prohi bition, unconstitutionally discriminates with regard to the revocation of dues check-off privileges as a sanction for a prohibited strike between public employee unions operating in local jurisdictions…
