This action arises from the conduct of Liberty Mutual Fire Insurance Company (“Liberty”) as a workers’ compensation insurer. In the course of that conduct, Liberty took the position that it had obtained assignments from plaintiffs to commence lawsuits against third parties for injuries plaintiffs suffered as a result of a work-related accident.
