On October 19, 1931, after verdict rendered by a jury, a judgment was entered in this case in favor of the plaintiff and against the defendant and' appellant, Semmler. Thereafter the appellant appealed from the taxation of costs, as made by the clerk of courts, to the judge who tried the case. On the 8th day- of July, 1932, the trial judge made an order retaxing the costs.
