Henry Waggy and F. J. Baxter appeal from a decree of the Circuit Court of Braxton comity in a chancery canse therein pending wherein they were defendants and J. W. Morrison was plaintiff. The plaintiff, in his bill, alleged : “That on the 8th day of February, 1888, lie entered into a contract with defendant Henry Waggy, by which he conditionally purchased a one undivided moiety of nine hundred acres of land situated in the county of Clay, on the north side of and adjacent to Elk river, and known as the ‘Jack Bend Land,’ and the defendant agreed to convey the same to him by deed…
