DECISION AND ORDER
ARCARA, District Judge.
On July 22,1999, claimant Connor White was seriously injured in a single-vessel boating accident on Lake Erie in Buffalo, New York. According to the record, the circumstances surrounding the accident are as follows: unbeknownst to the boat’s owners, claimants White and Sara demen-ti boarded the vessel M/Y Group Therapy with a group of Mends. Upon discovering the boat’s keys in a drawer, the group collectively decided to take the boat out for a ride.
