MANSFIELD, District Judge.

Plaintiff brought this action to contest the validity of his removal as a civilian employee from the position of Oiler for the Military Sea Transportation Service, Department of the Navy, on the ship USNS Geiger, which was manned by civilian employees and engaged in the transportation of troops to Viet Nam. He was removed by order of Admiral Whittaker, the commanding officer of the Military Sea Transportation Service, Atlantic area.
