Statement of the case by Green, Judge : The defendant, Henry S. Hallwood, claimed that about ■January 1, 1882, he purchased of George Straughan, the plaintiff’s father, a theodolite and a part of a set of drawing instruments. Mathew H. Straughan claimed that this property all belonged to him, and he brought a suit for it against Henry S. Hallwood before a justice of the county of Ka-nawha, where Hallwood resided.

From the pleadings and proofs in this case it appears, that cross-actions were pending in the Circuit Court of Kanawha county on the common-law and chancery side of said court, in which Mathew H. Straughan and Henry S. Hailwood were parties. The common-law suit involved the title to a theodolite and a part of a set of drawing instruments; and the chancery cause also involved the title to this property, and some dispute about accounts between Hailwood and Straughan’s father.
