The defendant, Moses H. Harris, leased from the Bedell Company, the plaintiff, under a lease expiring April 30, 1927, a part of premises No. 17 West Thirty-fourth street, New York city. On that day the appellant was obliged by covenant to surrender possession of the premises to the plaintiff but refused to do so, claiming the right to a renewal of the lease. The defendant continued in possession until the month of June, 1928, when the Court of Appeals affirmed a judgment of this court which decided that there was no renewal right and that the appellant’s continued possession was wrongful.…
