This is an appeal from a judgment of the City Court of the City of New York, entered upon the verdict of a jury in favor of the plaintiff, and from an order denying a motion for a new trial.
The action was brought to recover damages for an alleged assault ■committed by the defendant on the plaintiff at the farmer’s place of business. The plaintiff was the only witness on his behalf as to the alleged assault.
