MEMORANDUM OPINION AND ORDER
RUBEN CASTILLO, District Judge.
This case is before the Court on direct appeal from the United States Bankruptcy Court pursuant to 28 U.S.C. § 158(a). On October 14, 2005, Jeffery Eckert (the “Debtor”), filed a voluntary Chapter 7 bankruptcy petition. (R. 3, 3-3, Bk. Dkt. No. 104, at 4.) On May 24, 2007, the Debt- or’s Chapter 7 Trustee, Plaintiff/Appellee David E.
