MARBLEY, District Judge.

I. INTRODUCTION

This matter is before the Court on the Defendant’s Motion for Summary Judgment, filed on December 16, 2002. The Defendant seeks summary judgment with respect to the Plaintiffs claim brought pursuant to 42 U.S.C. § 1983, alleging retaliation in violation of the First Amendment to the United States Constitution.

For the following reasons, the Court DENIES the Defendant’s Motion for Summary Judgment in part and GRANTS the Defendant’s Motion in part.
