MILLER, Justice:

The State appeals an order of the Circuit Court of Ohio County which granted habe-as corpus relief to the defendant, Charles D. Maraño, by setting aside his conviction for first degree murder. 1 The court, in its order, relied principally upon two grounds: (1) the compulsory production of papers delivered by the defendant to psychiatrists retained by his attorney, in violation of the Fourth, Fifth, and Sixth Amendments, and (2) ineffective assistance of counsel in violation of the Sixth Amendment.
