The appellee, who was the plaintiff, brought this action, in the Circuit Court, against the appellant, who was the defendant, to recover lot No. 1 in Block No. 6, in the town of Greensboro, Henry county. The Court tried the issues, and found for the plaintiff. New trial refused, and judgment, &c. The plaintiff claimed title to the lot in controversy under a sale, on execution from the Henry Common Pleas, and a sheriff’s deed made pursuant to that sale.
