Between 1921 and 1927, plaintiff loaned to defendant Thomas Hocking various sums of money aggregating approximately $2,000. During the months of March and April, 1927, he undertook to procure a mortgage from Hocking to secure the payment of the amount, but without success. On March 12, 1927, Hocking, by warranty deed, conveyed to deféndant Sarah Budgen the lands in controversy; the same was recorded in the office of the county clerk on April 6, 1927.
