—Judgment unanimously affirmed. Memorandum: Defendant was convicted following a jury trial of rape in the first degree (Penal Law § 130.35 [3]) and endangering the welfare of a child (Penal Law § 260.10 [1]). The conviction arises from an incident on April 24, 1996 when defendant engaged in sexual intercourse with his girlfriend’s eight-year-old daughter. A previous trial on the same charges had resulted in a mistrial.
