This is an appeal from a decree dissolving an injunction issued at the instance of the appellants against the appellee, and dismissing the bill. The appellee entered into an agreement with Messrs. Brown and Butcher, by which it authorized them to remove and sell the tar in a pond on its premises in Anne Arundel County. Messrs. Brown and Butcher subsequently assigned their interest in the agreement to the Impervious Product Company of West Virginia, with the consent of the appellee.
