Plaintiff was a subcontractor with defendant Newbern, principal contractor, on a house of the other defendant Dolson. We do not discover from the state of the case whether plaintiff’s contract with Newbern was in writing; probably it was not, as there is a dispute on the evidence whether the contract price was $530 or $535, a question which is immaterial because the action was in the District Court and the excess over $500 was waived as required by the statute.
