Philip D. Myers appeals from the district court order dismissing his civil rights complaint filed pursuant to 42 U.S.C. § 1983. We affirm.

Appellant, who is presently incarcerated in the Missouri State Penitentiary in Jefferson City, was convicted of robbery in Missouri state court in 1974 and sentenced .to twenty-five years imprisonment. On November 14, 1977 he filed a civil rights lawsuit (No. 77-1026-0(3)) against Clyde H. Bull, a former Maplewood, Missouri police officer.
