SPENCER, District Judge.

A. Procedural History:

Petitioner, Michael Wayne Williams, was convicted of two capital murders and sentenced to death after a jury trial. The Supreme Court of Virginia affirmed on direct appeal and later dismissed petitioner’s state habeas petition. He then sought federal habeas relief and requested an evi-dentiary hearing on constitutional claims that he had been unable to develop in state court proceedings.
