Appeal from Bremer District Court. — Hon. C. H. Keleey, Judge. Dependant was indicted and convicted of cheating by false pretense. It was alleged that he obtained certain money, from one Dickinson, upon a check drawn upon a bank in which he had no funds, and no ground for believing that the check would be paid when presented.

Defendant was indicted on the charge of cheating, by false pretense, and it was alleged in the indictment that for the purpose of obtaining, from one Earl Dickinson, $50 in money, the property of Earl Dickinson, and to have the said Earl Dickinson believe that the defendant had money on deposit in the Farmers’ & Merchants’ State Bank of Morgan, Minn., and with fhe intent to defraud the said Dickinson, and to induce him to part with his money, he did then and there offer to Dickinson his check for $50 on said bank, and did designedly, falsely, and feloniously pretend and represent to said…
