BAUER, Circuit Judge.

On February 18, 1999, a grand jury returned a two-count indictment charging Hector Sandoval with kidnapping, 18 U.S.C. § 1201(a)(1), and carrying a firearm during and in relation to a violent crime, 18 U.S.C. § 924(e)(1)(A). After a trial on August 28, 2002, a jury convicted Sandoval on both counts and his September 5th motion for a new trial was denied. On December 13, 2002, the district court sentenced the defendant to a 121-month term of imprisonment on the kidnapping count and a 120-month consecutive term of imprisonment on the firearm count.
