Wen Liu and Ho Yin Lam, the plaintiffs, sued the United States Attorney General, the Secretary of the Department of Homeland Security, and five others (together, “the government”). Liu and Lam alleged that the Board of Immigration Appeals (“BIA”) decision upholding the denial by the United States Citizenship and Immigration Services (“USCIS”) of the 1-130 petition Lam filed on Liu’s behalf was arbitrary and capricious.
