On February 7, 1997, Dee Kilgore, William B. Doyle, Michael J. Antonio, Jr., and Kelby E. Strickland (hereinafter collectively referred to as "the Kilgore plaintiffs") filed a "sale-for-division suit" pursuant to Ala. Code 1975, § 35-6-58, against Samuel T. Robino (hereinafter referred to as "Robino") and Joseph T. Robino, Jr., seeking the sale of a parcel of real estate located in Shelby County and the division of the proceeds from the sale.
