This matter came before the Court on Monday, October 23, 2006, on Defendant’s motion to dismiss and Plaintiffs’ motion for class certification. The Court granted in part and denied in part Defendant’s motion to dismiss on December 18, 2006. Now, after carefully considering the parties’ written and oral arguments, the record, and governing law, the Court GRANTS IN PART Plaintiffs’ motion for class certification.
