COLLINS, Justice.

This suit was brought by N. B. Gilbreath against Farmers Mutual Insurance Association of Erath County, Texas, to recover $1,500 for the loss of his household goods under a fire insurance policy alleged to have been issued by defendant. The insurance association answered by a general denial and by a specific denial that it issued the policy of insurance. Defendant further alleged that under its charter, constitution and by-laws it was limited in the issuance of fire insurance policies covering farm homes, household furniture and farm equipment to property located in Erath…
