This case arises from the.contamination of the Ogal-lala aquifer under plaintiff United Proteins, Inc.’s (UPI) pet food plant by hexavalent chromium released by defendant Farmland Industries, Inc. (Farmland). UPI sought damages for holding costs it allegedly incurred due to its inability to sell.the plant on. theories of trespass and intentional private nuisance after its strict liability and negligence theories were dismissed as barred by the statute of repose.
