MEMORANDUM OPINION
WALTON, District Judge.
Plaintiffs, Mylan Laboratories, Inc., My-lan Technologies, Inc., and Mylan Pharmaceuticals, Inc. (collectively “Mylan” or “plaintiffs”), commenced this action against Tommy G. Thompson, Secretary of Health and Human Services (“HHS”); Lester M.
