Plaintiff, T. G. Cole, as administrator of tlie estate of W. P. Cole, deceased, brought this action against the defendants-, Continental Coal Corporation, of Tennessee, and Robert Mattingly, to recover damages for the death of his intestate, which is alleged to have resnlted from the gross negligence of the defendants. From a verdict and judgment in favor of plaintiff for the snm of $15,000, the defendants appeal.
