CLELAND, District Judge.
This matter is before the court on Defendants’ November 29, 2004 “Motion to Dismiss and/or [for] Summary Judgment.” This is Defendants’ second motion to dismiss the case. On March 26, 2001, this court issued a detailed written order granting Defendants’ original motion to dismiss based on a lack of jurisdiction and want of a cause of action. Westside Mothers v.
