Dewey & Stone brought an action in the district court ■of Greeley county against Jordan & McCarthy on two promissory notes of $250, each dated March 1, 1888, and due in thirty and sixty days. At the same time they filed an affidavit for and caused a writ of attachment to be issued and levied upon the property of Jordan & McCarthy. Jordan & McCarthy filed a motion to discharge this attachment, and at the same time filed an affidavit in which they denied the truth of all the allegations in the affidavit made by Dewey & Stone to obtain the attachment.
