In the affidavit of the defendant upon which the appeal to this court was allowed, various irregularities concerning the proceedings before the justice of the peace are alleged; and, in an affidavit made by the defendant’s attorney, submitted upon argument of this appeal, it is stated that the said justice admitted to the deponent that the information had not been read to the defendant, either by said justice or by any one under his direction, and that neither the said information nor the constable’s affidavit herein was drawn up, signed and sworn to until after the defendant had been fined…
