The petitioner applies for an order directing the respondents to desist and refrain from further proceedings *573upon a summons and information charging the petitioner with violation of the Yonkers Building Code. The information was made, verified and filed in the Yonkers City Court by a private citizen and not by the Department of Buildings, the Superintendent of Buildings or any other officer or employee of the department or the city.
