MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

On February 23, 1998, the petitioner Victor Perez (“Petitioner” or “Perez”) moved pursuant to 28 U.S.C. § 2255 to vacate, set aside or correct his sentence arising from his 1991 conviction in - this Court. In a decision dated August 4, 2003, the Court denied this petition in all respects. See, Perez v. United States of America, 274 F.Supp.2d 330 (E.D.N.Y.2003). The Petitioner now moves for re consideration of the August 4, 2003 decision, or in the alternative, or for an eviden-tiary hearing.
