This is an action of tort to recover for personal injuries received by the plaintiff while a passenger in *133an automobile, owned and operated by the defendant, on April 4, 1931. The declaration is in two counts, the first alleges negligence of the defendant, and that the plaintiff was a passenger for hire; the second count alleges gross negligence of the defendant when the plaintiff was riding in his automobile as a passenger.
