The plaintiff, James A. Hendrix, appeals from the trial court's order dismissing his petition to compel Governor Guy Hunt to appoint him to the office of supernumerary district attorney. We affirm.
The facts of this case are not in dispute. Hendrix was elected to the office of district attorney of Baldwin County, Alabama (then called "circuit solicitor") in November 1958, and he served in that capacity until January 1981.
